🚀 Brazil's Attorney General Urges Supreme Court To Dismiss Challenges Against Social Media Ban
#Brazil #AttorneyGeneral #SupremeCourt #SocialMediaBan #ElonMusk #FreeSpeech #Misinformation #PoliticalDebate #Regulation #NationalSovereignty
According to Cointelegraph, Brazil’s Attorney General’s Office (PGR) has called on the Supreme Court to reject legal actions contesting the ban on social media platform X. The PGR contends that suspending Elon Musk’s platform does not infringe on free speech rights and asserts that the lawsuits challenging the ban lack legal merit. This follows Justice Alexandre de Moraes’s decision to block the platform on August 30 after it failed to appoint a local legal representative, as required by Brazilian law for social media platforms operating in the country.
Previously, X had refused to comply with orders from the Brazilian Supreme Court to remove content deemed harmful, including misinformation and extremist rhetoric. The PGR’s review of the case was prompted by appeals from the Brazilian Bar Association and the political party Partido Novo, which contested the platform’s suspension and a $9,000 daily fine for users accessing it through virtual private networks (VPNs). The PGR stated that the legal mechanism used in the appeals cannot be applied to challenge Supreme Court rulings, emphasizing that it is not theoretically permissible to raise a claim of noncompliance with a fundamental precept against an STF judicial decision.
Supreme Court Justice Marques Nunes, who is reviewing the appeals, is expected to refer the case to the court’s plenary only after the country’s municipal elections in October. The court’s panel had previously upheld Moraes’s decision to ban the platform on September 2. The controversy between Musk and the Supreme Court has also sparked intense debates among Brazilian lawmakers. Some representatives have defended Musk’s claims of censorship, citing concerns about free speech, while others have condemned his actions as a threat to Brazil’s sovereignty and called for regulation of social platforms. Conservative congressman Nikolas Ferreira criticized the lack of transparency in blocking social media accounts, while Congressman Ivan Valente argued that Musk’s actions undermine Brazil’s national sovereignty.#Brazil #AttorneyGeneral #SupremeCourt #SocialMediaBan #ElonMusk #FreeSpeech #Misinformation #PoliticalDebate #Regulation #NationalSovereignty
🚀 Brazil May Lift Ban On Elon Musk's Social Media Platform X
#Brazil #ElonMusk #SocialMedia #PlatformX #Misinformation #SupremeFederalCourt #Starlink #Cloudflare #FakeNews #ElectoralProcesses #JusticeSystem #AttorneyGeneral #Censorship #Dictator #PoliticalMotivation
According to Cointelegraph, Brazilian authorities may soon lift the ban on Elon Musk’s social media platform X after the company paid 28.6 million Brazilian reais (approximately $5.5 million) in fines.
On October 7, X fulfilled the latest requirement to return online, following a suspension by Brazil’s Supreme Federal Court in late August for failing to comply with orders related to an investigation into the spread of misinformation in the country. The final payment was confirmed after a series of unusual events, including a mistaken deposit of the funds into the wrong bank account on October 4. The proceeds, paid by Musk’s satellite company Starlink, were eventually transferred to the correct account.
The amount included the original fine for X’s lack of cooperation in court investigations and an additional 10 million Brazilian reais (about $1.9 million) for not complying with the suspension after a shift to Cloudflare’s servers unintentionally allowed some users to access the platform in September. In recent days, X also appointed a new legal representative in Brazil, as required by local regulations, and blocked the accounts of users accused of spreading fake news and misinformation about Brazil’s electoral processes and justice system.
The platform’s return to users in the country now rests with Brazil’s Attorney General, who will recommend whether or not the suspension of X in Brazil should be lifted. If approved, Justice Alexandre de Moraes will review the case and issue his decision. Justice Moraes has been investigating X since 2023 for allegedly promoting and enabling the spread of misinformation in Brazil. Musk is also under investigation for charges including obstruction of justice, involvement in a criminal organization, and incitement to crime.
The billionaire has publicly criticized Moraes’ actions, labeling them politically motivated censorship and accusing the judge of behaving like a “dictator” by targeting political opponents through what he claims are unlawful demands for content moderation.#Brazil #ElonMusk #SocialMedia #PlatformX #Misinformation #SupremeFederalCourt #Starlink #Cloudflare #FakeNews #ElectoralProcesses #JusticeSystem #AttorneyGeneral #Censorship #Dictator #PoliticalMotivation

According to PANews, U.S. President Donald Trump has initiated actions against the 'de-banking' of controversial industries, including digital assets, prompting the Office of the Comptroller of the Currency (OCC) to release a new report. This report reaffirms previous practices and warns that banks involved may face penalties.
The OCC's brief report reviewed the practices of the nine largest national banks in the United States, concluding that from 2020 to 2023, these banks established both public and private policies that restricted certain industries from accessing banking services. These restrictions included requiring enhanced reviews and approvals before providing financial services.
The report highlights that some major banks have set higher entry barriers for controversial or environmentally sensitive businesses, or activities that conflict with the banks' values. Notable financial institutions such as JPMorgan Chase, Bank of America, and Citigroup were specifically mentioned, with references to their past public policies, particularly concerning environmental issues.
The OCC intends to hold these banks accountable for any illegal 'de-banking' activities, potentially referring cases to the Attorney General. However, it remains unclear which specific laws these activities might violate.#Trump #digitalassets #debanking #bankingpractices #OCC #JPMorganChase #BankofAmerica #Citigroup #financialservices #environmentalissues #financialinstitutions #USA #AttorneyGeneral
