๐Ÿš€ DCG And Former Genesis CEO Settle SEC Fraud Charges With $38.5 Million Penalty

According to CoinDesk, Digital Currency Group (DCG) and Soichoro โ€œMichaelโ€ Moro, the former CEO of its now-defunct Genesis subsidiary, have agreed to pay a total of $38.5 million in civil penalties to resolve securities fraud charges with the U.S. Securities and Exchange Commission (SEC). DCG will pay $30 million, while Moro will be responsible for a $500,000 penalty. Both parties have also agreed to a cease-and-desist order, although neither admitted to any wrongdoing. Moro currently serves as the chief strategy officer at INX.

The charges are linked to DCG and Genesis' actions following the collapse of crypto hedge fund Three Arrows Capital (3AC) in the summer of 2022. 3AC was Genesisโ€™ second-largest borrower, and its downfall left a significant financial gap in Genesisโ€™ balance sheet. A DCG spokesperson stated that the investigation focused on social media posts and communications by Genesis Global Capital, emphasizing that DCG has always aimed to operate with integrity.

Regulators, including New York Attorney General Letitia James, accused DCG and Genesis of attempting to conceal the financial shortfall by falsely claiming that DCG had absorbed Genesisโ€™ losses. Allegedly, DCG issued Genesis a promissory note, pledging to pay $1.1 billion over ten years at 1% interest, to create an appearance of liquidity. DCG has denied these allegations, asserting that the promissory note was legitimate.

Sanjay Wadhwa, Acting Director of the SECโ€™s Division of Enforcement, emphasized the importance of transparency, especially during financial instability. He stated that DCG and Moro failed to provide an accurate portrayal of Genesisโ€™s financial condition and DCGโ€™s efforts to support Genesis. The SEC and the Department of Justice began investigating DCG in 2023, and Jamesโ€™ civil case against DCG is ongoing, with a demand for $3 billion in penalties.

According to ChainCatcher, blockchain investigator ZachXBT has disclosed that Danny/Meech, also known as Danish Zulfiqar (Khan), is suspected to have been arrested by law enforcement and had his crypto assets seized. Zulfiqar was allegedly involved in a $243 million theft from Genesis creditors, alongside Malone, Veer, Chen, and Jeandiel. However, Dubai police or UAE regulatory authorities have not made any public statements, nor has any local media reported confirming any villa raids, arrests, or seizures related to Zulfiqar, the Genesis creditors theft case, or the earlier Kroll SIM card swap incident.
